STAR CITY SCHOOL OF BALLET

These Terms of Service (“Terms”) constitute a legally binding agreement between you, whether acting personally or on behalf of a child, family, organization, or other entity (“you” or “your”), and Star City School of Ballet (“Star City,” “School,” “we,” “us,” or “our”).
These Terms govern your access to and use of:

Website chat and messaging features;

Email and text-message communications;

Customer relationship management and follow-up services;

Online scheduling, registration, and related digital services; and

Any other website, form, service, or communication channel that links to these Terms.
These services are collectively referred to as the “Services.”
By accessing or using the Services, submitting a form, creating an account, or otherwise interacting with the Services, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, you must not use the Services.

Star City School of Ballet provides dance education, training, performances, camps, intensives, events, studio activities, and related programs.
2. Additional Policies and Agreements
These Terms apply to the School’s digital Services. Participation in classes, performances, camps, intensives, auditions, studio rentals, or other School programs may also be governed by separate agreements or policies, including:

Enrollment agreements;

Tuition and payment policies;

Registration terms;
-
Attendance policies;
-
Student and parent handbooks;
-
Liability waivers;
-
Medical and emergency forms;
-
Photography or media releases;
-
Codes of conduct;
-
Refund or cancellation policies; and
-
Program-specific rules.
If a program-specific agreement conflicts with these Terms regarding participation in that program, the program-specific agreement will control for that issue.
Our Privacy Policy is incorporated into these Terms by reference.
3. Eligibility and Use by Minors
Star City School of Ballet serves children, teenagers, and adults. However, children may not independently enter into binding contracts or provide consent where parental or legal-guardian consent is required.
If you are under 18 years old, you may use the Services only with the involvement and permission of a parent or legal guardian.
A parent or legal guardian must submit registration, payment, consent, medical, emergency-contact, and similar information on behalf of a minor where required.
Children under 13 may not independently submit personal information through the Services. A parent or legal guardian must provide information on their behalf.
By registering a minor or submitting information on a minor’s behalf, you represent that you are authorized to do so.
4. User Information and Representations
By using the Services, you represent and warrant that:

The information you provide is accurate, current, and complete;

You will promptly update information when it changes;

You have authority to provide information concerning any minor or other person included in a submission;

You have the legal capacity to agree to these Terms;

You will use the Services only for lawful purposes;

You will not submit false, fraudulent, misleading, or unauthorized information;

You will comply with these Terms and other applicable School policies; and
-
Your use of the Services will not violate applicable law or another person’s rights.
We may reject, suspend, or terminate a submission, registration, account, or inquiry if information is false, incomplete, misleading, or submitted without proper authorization.
5. Accounts and Access Credentials
Certain Services may require an account, login, password, verification code, or other credentials.
You are responsible for:

Maintaining the confidentiality of your credentials;

All activity conducted through your account;

Using accurate account information;
-
Preventing unauthorized access; and
-
Promptly notifying us of suspected unauthorized access.
You may not share credentials with unauthorized individuals, impersonate another person, or attempt to access another user’s account.
We may suspend or restrict account access when reasonably necessary to protect the School, its students, families, systems, or other users.
6. CRM, Inquiry, and Follow-Up Services
Star City School of Ballet may use customer relationship management technology, including technology provided or supported by third-party vendors, to:

Receive and organize inquiries;

Maintain contact records;
-
Respond to questions;
-
Provide class or program information;
-
Schedule consultations, visits, auditions, or trial classes;
-
Send registration or deadline reminders;
-
Follow up with prospective and current families;
-
Communicate schedule or program updates;
-
Provide customer support;
-
Measure marketing and enrollment activity; and
-
Improve our services and communications.
Submission of an inquiry does not guarantee enrollment, placement, acceptance, availability, admission, casting, financial assistance, or participation in any School program.
7. Text Message Terms
7.1 Separate Consent
Where you affirmatively provide your mobile telephone number and consent to receive text messages, you authorize Star City School of Ballet and its service providers to send SMS or MMS messages to that number.
Your acceptance of these Terms alone does not necessarily enroll you in recurring marketing text messages. Consent will be requested separately where required.
Consent to receive marketing text messages is not a condition of purchasing services or enrolling in a School program.
7.2 Types of Messages
Messages may include:

Trial-class or audition follow-up;

Appointment reminders;
-
Class, rehearsal, or schedule updates;

Program announcements;

Enrollment reminders;

Deadline notifications;

Other School-related communications you requested or consented to receive.
7.3 Automated Technology
Some messages may be sent using an automated telephone dialing system, CRM platform, or similar automated technology.
7.4 Message Frequency and Charges
Message frequency varies based on your relationship with the School, the programs in which you express interest, and your communication preferences.
Standard message and data rates may apply according to your mobile carrier and service plan.
Star City School of Ballet is not responsible for charges imposed by your mobile carrier.
7.5 Opting Out
You may revoke consent and stop text messages at any time by replying:

We may also recognize other reasonable language that clearly communicates that you no longer wish to receive messages.
After an opt-out request, you may receive one non-promotional message confirming that the request has been processed.
Opting out of marketing messages does not necessarily prevent the School from sending non-marketing messages that are legally permitted or necessary to administer an existing registration, transaction, safety matter, or program relationship.

7.7 Telephone Number Changes
You agree to notify us if you discontinue or change a mobile telephone number that you previously provided.
You may not provide a telephone number unless you are the subscriber, customary user, or otherwise authorized to provide consent for that number.
7.8 Mobile Carriers
Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless provider and is not guaranteed.
7.9 Mobile Consent Data
Mobile opt-in information and consent records will be used to administer the School’s messaging program and handled in accordance with our Privacy Policy.
We will not sell mobile opt-in information or share text-message consent with third parties for their own independent marketing or promotional purposes.
We may share information with vendors that help us operate the messaging service, but only as reasonably necessary to provide those services.
8. Email Communications
By providing an email address, you authorize the School to send communications relating to:

Your inquiries;

Registrations;
-
Classes or programs;
-
Auditions or trial classes;

Events and performances;
-
Schedule changes;
-
Customer service;
-
School news;
-
Enrollment opportunities; and
-
Promotional offerings.
Commercial or promotional emails will include a method for opting out of future marketing emails where required.
You may unsubscribe using the link included in an email or by contacting the School.
Unsubscribing from promotional email may not prevent delivery of transactional, registration, safety, payment, scheduling, or other non-promotional communications relating to an existing relationship with the School.
9. Electronic Communications and Signatures
Visiting the website, submitting online forms, sending emails, communicating through chat, and communicating by text message constitute electronic communications.
You consent to receive agreements, notices, disclosures, records, and other communications electronically.
To the extent permitted by law, electronic signatures, checkbox acknowledgments, online submissions, and electronic records will have the same legal effect as paper records and handwritten signatures.
10. User Submissions
The Services may allow you to submit information or materials, including:

Names and contact information;

Registration information;
-
Student information;
-
Messages and inquiries;
-
Photographs or videos;
-
Audition materials;
-
Resumes or biographies;
-
Forms and documents;
-
Testimonials; or
-
Other content.
These materials are referred to as “User Submissions.”
You retain any ownership rights you possess in your User Submissions.
You grant the School a non-exclusive license to receive, store, reproduce, process, and use User Submissions as reasonably necessary to:

Administer registrations or programs;

Evaluate auditions or placement;

Communicate with you;

Provide the requested Services;
-
Maintain School records;
-
Comply with legal obligations; and

Protect the School and its community.
Public marketing use of a student’s name, image, photograph, video, or performance likeness will remain subject to any applicable media-release or photography-consent terms.
You represent that you have the right to submit all materials you provide and that the materials do not violate another person’s privacy, intellectual property, or other legal rights.
11. Prohibited Activities
You may not use the Services to:

Violate applicable law or regulation;

Submit false, fraudulent, misleading, or unauthorized information;

Impersonate another person or misrepresent your relationship with another person;

Access another person’s account or private information without authorization;
-
Circumvent or interfere with security or access controls;
-
Introduce viruses, malicious code, spyware, ransomware, or other harmful technology;
-
Disrupt the website, CRM, communications systems, or connected networks;
-
Use automated scraping, crawling, extraction, or data-mining tools without written permission;
-
Collect or use information about students, families, staff, or users for unauthorized purposes;
-
Harass, threaten, intimidate, exploit, or harm another person;
-
Submit unlawful, defamatory, obscene, abusive, discriminatory, or infringing content;
-
Send unsolicited advertisements, spam, or unauthorized messages through the Services;
-
Copy or commercially exploit School content without permission;
-
Attempt to discover passwords, security information, source code, or system vulnerabilities; or
-
Use the Services in a manner that creates an unreasonable burden or security risk.
We may investigate suspected violations and restrict or terminate access when reasonably necessary.
12. Intellectual Property
Unless otherwise indicated, the Services and their content are owned by or licensed to Star City School of Ballet.
Protected materials may include:

Logos and trademarks;

Photographs and videos;

Written materials;
-
Class and program descriptions;

Graphics;
-
Designs;
-
Software;
-
Databases;

Forms;

Communications;

Curriculum-related materials; and

You may use the Services and their content only for personal, noncommercial purposes connected with evaluating or participating in School programs.
You may not reproduce, republish, distribute, sell, license, modify, publicly display, or commercially exploit School content without prior written permission, except as permitted by law.
13. Third-Party Platforms and Services
The Services may rely on or link to third-party products and platforms, including:

CRM providers;

Website-hosting providers;
-
Payment processors;
-
Scheduling systems;
-
Email and SMS providers;
-
Social-media platforms;
-
Registration systems;
-
Video or file-hosting services; and
-
Other vendors.
Third-party platforms may have their own terms, privacy policies, availability limitations, and technical requirements.
The School does not control and is not responsible for the independent conduct, content, security practices, or availability of third-party services.
Use of a third-party service may require acceptance of that provider’s terms.
14. Program Information and Availability
We make reasonable efforts to provide accurate information regarding classes, faculty, schedules, tuition, performances, camps, intensives, and other programs.
However, information may change. The School may, when reasonably necessary:

Change instructors;

Adjust schedules;
-
Combine or cancel classes;
-
Change locations;
-
Modify program content;
-
Establish or revise prerequisites;
-
Limit enrollment;
-
Close registration;
-
Change performance or casting plans; or
-
Correct errors.
Website information does not constitute a guarantee that a particular class, instructor, role, program, schedule, or opportunity will remain available.
Specific payment, withdrawal, cancellation, credit, and refund rules are governed by the applicable enrollment or program policies.
15. Privacy
Our collection, use, retention, and disclosure of personal information are governed by the Star City School of Ballet Privacy Policy.
By using the Services, you acknowledge that you have reviewed the Privacy Policy.
Where required, separate consent will be requested for particular uses of personal information or communications.
16. Suspension and Termination
These Terms remain effective while you use the Services.
We may suspend, restrict, or terminate access when reasonably necessary due to:

Violation of these Terms;

Unlawful conduct;

Fraud or misrepresentation;

Security concerns;

Harassment or harmful conduct;

Unauthorized account access;
-
Misuse of School information;

Nonpayment under an applicable agreement; or

Conduct that threatens the School, its students, families, staff, systems, or community.
Termination of digital access does not eliminate payment or other obligations arising under a separate enrollment, registration, or program agreement.
17. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.
The School does not warrant that:

The Services will be uninterrupted or error-free;

Every error will be corrected;
-
Communications will always be delivered;
-
Third-party systems will remain available;
-
Information will always be current or complete; or
-
Use of the Services will produce a particular enrollment, placement, educational, artistic, or other result.
Nothing in this section limits rights or warranties that cannot lawfully be waived.
18. Limitation of Liability
To the fullest extent permitted by law, Star City School of Ballet and its directors, officers, employees, instructors, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of or inability to use the Services.
This may include loss of data, loss of opportunity, loss of revenue, interruption of service, or reliance on incomplete or inaccurate information.
To the fullest extent permitted by law, the School’s total liability arising from the digital Services will not exceed the amount paid by you specifically for the digital Service giving rise to the claim during the six months preceding the event, or $500 if no separate amount was paid for that Service.
This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
19. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Star City School of Ballet and its directors, officers, employees, instructors, contractors, and agents from third-party claims, damages, liabilities, and reasonable expenses arising from:

Your violation of these Terms;

Your unlawful use of the Services;

Information or content you submit;
-
Your infringement of another person’s rights;
-
Your lack of authority to submit information concerning another person; or
-
Fraudulent, harmful, or unauthorized activity conducted through your account.
The School may assume control of the defense of a claim subject to indemnification, and you agree to provide reasonable cooperation.
20. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
To the extent permitted by law, any legal proceeding arising from these Terms or the digital Services shall be brought in a court of competent jurisdiction located in the City of Roanoke, Virginia, or the applicable federal court serving that location.
Nothing in this section prevents either party from pursuing relief in another forum where applicable law requires it.
21. Changes to These Terms
We may revise these Terms periodically to reflect changes in:

The Services;

School operations;
-
Communications practices;
-
Technology;
-
Legal requirements; or
-
Third-party platforms.
Updated Terms will be posted with a revised “Last Updated” date.
Where legally required, we will provide additional notice or obtain renewed consent.
Continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
22. Assignment
You may not assign your rights or obligations under these Terms without the School’s written consent.
The School may assign these Terms in connection with a restructuring, merger, asset transfer, change in control, or transfer of the applicable Services.
23. Severability
If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary.
The remaining provisions will remain in effect.
24. No Waiver
Failure to enforce a provision of these Terms does not waive the right to enforce that provision later.
A waiver is effective only if made in writing by an authorized representative of the School.
25. Entire Agreement
These Terms, the Privacy Policy, and any applicable registration, enrollment, payment, waiver, or program-specific agreement constitute the complete agreement governing the applicable Services.
They supersede prior communications concerning the same subject matter.
